Terms of Business

Standard TERMS OF BUSINESS between:

 

  • Medicals UK Ltd, 1st Floor, Suite 1A, 173-175 Lees Road, Oldham, OL4 1JP (“Medicals UK”)

And

  • Unrepresented Claimant, (“Client”)
  • Compensator (“Compensator”)

 

This Agreement sets out the terms upon which the Client shall provide and Medicals (UK) Ltd shall accept instructions to provide the following services under the MedCo / OICL Portal Systems for Road Traffic Accidents (“the Services”):

  1. The obtaining of medical reports,
  2. The obtaining of medical records, and
  3. The performance of investigations, x-rays, scans, and other diagnostic tests all in relation to personal injury claims pursued by the Client (If instructed and approved by the compensator)
  4. Obtaining further reports, e.g., Orthopaedic, psychological, ENT etc. (If instructed and approved by the compensator)
  5. Arranging rehabilitation treatment such physiotherapy, CBT etc. (If instructed and approved by the compensator)

 

  1. Medicals UK:
    1. Will acknowledge instructions received via the OICL portal within 1 working day.
    2. Will contact the client within 2 working days once client consent has been received.
    3. Arrange an appointment with an appropriate MEDCO accredited expert at a date, time and location convenient to the Client.
    4. Arrange the medical examination to take place within 5 to 8 weeks of the date of instruction.
    5. Provide the medical report to The Client within 14 days of the date of examination.
    6. Obtain medical records only if recommended by the medical expert.
    7. Provide a response to any questions to the medical expert within 14 days of the date of receipt.
    8. Provide a response to any challenges raised on the medical report raised by the client within 14 days of receipt.

 

  1. The client agrees:
    1. To notify Medicals UK of the type of examination they require (face to face or a remote examination).
    2. To notify Medicals UK if they are unable to attend a medical appointment giving 2 working days’ notice.
    3. To attend the appointment as arranged. If the client does not attend or give sufficient notice as per their appointment letter, a DNA charge will be issued.
    4. To notify Medicals UK if they no longer require a medical examination. If an appointment has been arranged, notification must be received 2 working days prior to the appointment. If no contact has been made by the client within 30 days, the case will be closed, and any outstanding invoices will be raised.

 

  1. The Compensator shall pay Medicals UK’s fees for the Services it has provided.
  2. This Agreement shall be effective from the date of instructions received by Medicals UK.
  3. Medicals UK will go ahead and arrange the medical appointment for the client as per Client Instructions.
  4. This Agreement is subject to the law of England and Wales.
